Regional Transport Office in Srinagar prohibits sale and registration of vehicles involving minors
Authorities at the Regional Transport Office in Srinagar have issued a circular on Friday, prohibiting registered dealers, officers, officials of the Motor Vehicle Department, and insurance agencies from engaging in the sale, purchase, or registration of any vehicle involving a minor. The circular stated that motor vehicle dealers have sold and registered motor vehicles in the name of minors, which is a violation of Section 10 of the Indian Contract Act, 1872.

The circular emphasized that any sale agreement executed with a minor is considered void ab initio under the Indian Contract Act, 1872. It further stated that a registered motor vehicle, along with its registered owner, is a legal entity, and any violation of the provisions of motor vehicle laws and rules made under them by such a vehicle may result in penal action against the owner.

Therefore, the circular urged all registered dealers, officers/officials of the motor vehicle department, the general public, insurance agencies, and other stakeholders to refrain from making any sale/purchase or registering any vehicle involving a minor in the interest of law and justice.
