Srinagar Teacher Terminated After DSEK Finds No Record of Appointment Order

Srinagar, Oct 4: The Directorate of School Education Kashmir (DSEK) has declared a purported 2013 Government appointment of a Srinagar man null and void ab-initio after finding that the appointment, its official endorsement and his subsequent promotion as a Teacher were never issued by the competent authority.

The department has also ordered recovery of all benefits drawn by Imtiyaz Ahmad, son of Abdul Rahim Teli of Rawalpora, on the basis of the purported appointment and sought recovery of the amount from his property as arrears of land revenue.

The action followed an inquiry into Ahmad’s entry into the School Education Department, with the DSEK finding his appointment “non-est in the eyes of law”.

According to Order No. 347-DSEK of 2026 dated September 3, 2026, Ahmad was purportedly appointed as a Laboratory Assistant under Government Order No. 395 GAD of 2013 dated February 4, 2013, with an endorsement by the DSEK dated April 3, 2013.

He was subsequently purportedly promoted as Teacher under Order No. 1004-DSEK of 2018 dated July 30, 2018.

However, verification of departmental records found that no such appointment order, endorsement or promotion order had been issued by the competent authority, the Directorate said.

The matter surfaced after Ahmad, who had been working as a Teacher at Boys Middle School Gagribal in Zone Nishat, remained unauthorisedly absent from service from February 21, 2024.

A show-cause notice issued by the Zonal Education Officer, Nishat, on May 31, 2024, directing him to resume duties within seven days went unanswered.

The Chief Education Officer, Srinagar, subsequently reported the case to the Directorate, which ordered a detailed inquiry on February 16, 2026.

The inquiry report was submitted on April 25.

The Directorate later issued a final notice directing Ahmad to appear personally and produce his testimonials and the original appointment and promotion orders purportedly issued in his favour.

In his response, Ahmad acknowledged that he had been “misled and trapped” in a fraudulent and irregular process by certain individuals, the order said.

The DSEK, citing judgments of the Supreme Court and the High Court of Jammu and Kashmir and Ladakh, held that an appointment based on fraudulent or forged documents is “non-est in the eyes of law” and does not require a regular departmental inquiry before termination.

“Keeping in view the above facts, the fraudulent entry managed into the School Education Department by Mr. Imtiyaz Ahmad … being non-est in the eyes of law, is hereby declared null and void, ab-initio,” the order states.

The Directorate has asked the Deputy Commissioner, Srinagar, to recover the amount allegedly drawn by Ahmad from his property under the provisions of the J&K Land Revenue Act.

The Senior Superintendent of Police, Economic Offences Wing, Kashmir-Srinagar, has also been informed, while the Chief Education Officer, Srinagar, has been directed to take immediate necessary action.
