NEW DELHI, October 9, 2025 – Supreme Court to Hear J&K Statehood Petitions on October 10 ;The Supreme Court of India is scheduled to hear a batch of pivotal petitions seeking the restoration of statehood for Jammu and Kashmir on Friday, October 10.
The case, listed at serial number 17, will be heard by a bench headed by the Chief Justice of India (CJI). “The case is listed for hearing on October 10 before a bench headed by the Chief Justice of India,” confirmed advocate Soayib Qureshi, who is involved in the matter. He also noted that the Union of India has not yet filed its official response to the petitions.
This hearing follows previous judicial remarks that highlighted the complex security situation in the region. On August 14, a bench comprising Chief Justice BR Gavai and Justice K Vinod Chandran emphasized that “ground realities” must be considered, specifically referencing the recent attack in Pahalgam. “You must also take into account the ground realities; you cannot ignore what happened in Pahalgam,” the bench had observed.
The petitioners have put forward a constitutional argument, contending that the prolonged delay in restoring statehood undermines the principle of federalism—a feature they assert is part of the basic structure of the Indian Constitution.
A central point in their submission is the alleged lack of progress on the Supreme Court’s own directive from its December 2023 judgment on Article 370. In that landmark ruling, the court had explicitly stated that the “restoration of statehood shall take place at the earliest and as soon as possible.” The petitioners argue that no concrete steps or clear timeline have been established to fulfill this directive, making tomorrow’s hearing a critical juncture in the ongoing political and constitutional discourse surrounding Jammu and Kashmir.
